Visa Sponsorship Stages

1. Initial Consultation

We begin with a detailed consultation to understand the candidate’s qualifications and the employer’s staffing needs. This allows us to recommend the most suitable visa category and establish a roadmap for the sponsorship process.

2. Employer Documentation

Our team works closely with the employer to gather and prepare all necessary documentation, including:

  • Job Description: Detailed description of the position offered.
  • Employer Attestations: Statements affirming the employer’s compliance with visa sponsorship regulations.
  • Financial Documentation: Proof of the employer’s financial stability to support the sponsored employee.

3. Visa Application Preparation

We assist in completing the required visa application forms, which may include:

  • Form DS-160: Nonimmigrant Visa Application form for temporary stays.
  • Form I-129: Petition for Nonimmigrant Worker, used for most employment-based visa categories.
  • Labor Condition Application (LCA): Required for H-1B visas, certifying that the employer will pay the prevailing wage and meet working condition standards.

4. Visa Fees

Understanding the financial obligations involved is crucial. Visa sponsorship typically includes the following fees:

  • Visa Application Fee: Paid to the U.S. Department of State for processing the visa application.
  • USCIS Filing Fee: Paid with the Form I-129 for petition processing.
  • Premium Processing Fee (if applicable): Expedited processing of the Form I-129.
  • Attorney Fees: Legal representation throughout the process.

5. Visa Interview and Approval

Candidates must attend a visa interview at the U.S. embassy or consulate in their home country. Opti NextGen provides comprehensive guidance and preparation to ensure candidates are ready for the interview process.

6. Travel Preparation

Once the visa is approved, we assist candidates with travel arrangements, including flight bookings, temporary accommodation, and initial settling-in support in the U.S.

7. Arrival and Onboarding

Upon arrival in the United States, Opti NextGen coordinates with the employer to facilitate a smooth transition for the new employee. This includes orientation sessions, introduction to company policies, and assistance with initial paperwork.
